These are the terms and conditions (Conditions) of BE GROWEE S.R.L., Address: AUREL GURGHIANU, Nr. 29, Scara A, Etaj 1, Ap. 20, Cluj, CIF: 48619487, Reg: J12/3426/10.08.2023, Cluj-Napoca, Cluj, Romania. They govern the Contract (as defined below) between the Supplier and the Customer (as defined below) for the supply of the Services (as defined below).
1. Acceptance of Terms:
By using the Growee platform, you acknowledge that you have read, understood, and agreed to comply with these Terms and Conditions, as well as any additional policies or guidelines incorporated herein by reference.
2. Description of Services:
Growee offers a comprehensive suite of services including leave management, employee management, document management, and evaluation management. Our platform is designed to streamline and enhance these essential HR processes to optimize efficiency and productivity in your organization.
3. Account Registration:
To access our services, you must create an account on the Growee platform. You are responsible for maintaining the confidentiality of your account information, including your username and password. Any actions taken under your account will be your responsibility, unless these actions are provoked as a result of malfuction of the Growee product.
4. User Responsibilities:
a. You agree to use the Growee platform solely for lawful purposes and in accordance with these Terms and Conditions.
b. You will not engage in any activity that could harm, disrupt, or interfere with the proper functioning of our services or the data of other users.
c. You are responsible for ensuring the accuracy and completeness of the information provided while using our services.
5. Privacy Policy:
Your privacy is of utmost importance to us. We collect, use, and disclose your personal information in accordance with our Privacy Policy. By using Growee, you consent to our data practices as outlined in the Privacy Policy. All the data that Growee stores is encrypted upon transport and sensitive employee data is encrypted at the database level. We ensure that your company data is isolated and can be accessed only by Growee for support or debugging purposes in order to fix an issue related to the product or help a customer.
6. Intellectual Property:
All content, software, logos, trademarks, and other intellectual property used on the Growee platform are the sole and exclusive property of Growee or its licensors. You expressly agree not to use, reproduce, modify, distribute, or create derivative works from any copyrighted material or intellectual property without obtaining prior written consent from Growee. The trademarks associated with Growee, including the Growee name and logo, are protected under trademark laws, and any unauthorized use is strictly prohibited. Additionally, by using the Growee platform, you acknowledge that user-generated content may be shared, but you retain ownership of the intellectual property rights to your contributions.
Growee respects the intellectual property rights of others and expects the same from its users. If you believe that any content on the Growee platform infringes upon your intellectual property rights, please contact us promptly at support@growee.net. We will thoroughly investigate any reported infringement and take appropriate action to address the issue. By accessing or using the Growee platform, you agree to comply with all applicable intellectual property laws and regulations, and you are granted a limited license to access and use the platform solely for its intended purposes under the provided Terms and Conditions. Any violation of these provisions may lead to the termination of your account and may result in legal action to protect Growee's intellectual property rights.
7. Third-Party Services:
Growee may integrate third-party services, such as SignRequest, Google Calendar, Google Authentication, and AWS, to enhance the functionality of our platform. Please be aware that these integrated services are governed by their respective terms and conditions, which are separate from Growee's policies. Your use of these third-party services through the Growee platform is subject to the terms and conditions of each individual provider.
8. Limitation of Liability:
Growee shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages that may arise out of or be connected with the use or inability to use our services. Whether due to errors, interruptions, inaccuracies, system failures, or any other reason, Growee disclaims any responsibility for potential losses or damages incurred while using our platform. Users are solely responsible for the decisions they make and the actions they take based on the information and functionalities provided by Growee. By using our services, you agree to indemnify and hold Growee harmless from any such claims, damages, or losses.
Modifications to Services:
Growee reserves the right to modify or discontinue any aspect of its services at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of our services.
10. Termination:
Growee reserves the right to suspend or terminate your account for reasons such as not making payments, violating Terms and Conditions rules or impacting Growee in a negative way through spam or other methods. Upon termination, you will lose access to all data and information associated with your account, however you can request a zip archive if needed.
11. Governing Law:
These Terms and Conditions shall be governed by and construed in accordance with the laws of Romania, Cluj county, Cluj-Napoca. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Romania, Cluj county, Cluj-Napoca.
12. Changes to Terms and Conditions:
Growee may update these Terms and Conditions from time to time without prior notice. The revised version will be effective immediately upon posting. Continued use of our services after any changes constitutes your acceptance of the revised Terms and Conditions.
